Terms & Conditions of Findley House  Limited Definitions “We” or “us” means Findley House Limited of Unit 13, Shaw Wood Way, Doncaster. DN2 5TB. “You” means the person who buys or agrees to buy goods from us.

1 Contract

 

1.1 Once we have received your order and full payment in cleared funds for the price of the goods we will confirm that your order has been accepted in writing. On acceptance of your order, you will enter a legally binding contract between us that is subject to the following terms and conditions.

1.2 We reserve the right to change these terms and conditions at any time. Any changes made will commence with immediate effect and it is your responsibility to read these terms and conditions each time you visit our website.

2 Price of Goods

2.1 The price you will pay is the price displayed on the goods at the time you place your order. Although every attempt is made to ensure these prices are accurate errors may occasionally occur. If we discover an error has occurred we will inform you as soon as possible and allow you to either purchase the goods at the correct price or cancel your order. If you have already paid for the goods a full refund will be given.

3 Description of Goods

3.1 We make every effort to describe all of our products as accurately as possible and give reliable information regarding colour, dimensions and technical specifications. We must emphasise that such descriptions by their very nature can only be approximate.

3.2 The photographs shown on our website are for illustrative purposes only and may not exactly match the goods themselves.

3.3 We may make changes in the specification of the goods which do not affect their quality or performance where such changes are required to conform with any applicable legal requirements.

3.4 Natural fissures and fossils are also common to stone and marble, although every effort will be made to ensure such characteristics are not detrimental in any way to the natural beauty of your fireplace they will not be considered a fault.

4 Payment

 

4.1 We will take full payment from your card at the time we receive your order.

5 Supply of Goods 

 

5.1 Supply of goods is subject to availability. In the event of unforeseen shortfalls in stock or if we are unable to supply the goods immediately, we will inform you of any potential delays in delivery. If we are unable to supply the goods within an acceptable timescale a full refund will be given.

6 Delivery 

 

6.1 All deliveries must be signed for by an adult aged 18 or over. It is not our responsibility to identify the person signing on your behalf or to establish whether or not such person is authorised to sign for the goods on your behalf.

 

6.2 We shall make every effort to deliver your goods within the estimated timescale but delays may occur due to unforeseen circumstances. We are therefore under no liability for any delay or failure to deliver the goods within the estimated timescales. Where you are requiring a third party to install the goods we advise you to wait until you are in receipt of the goods before arranging installation.

6.3 You will become the owner of the goods once they have been delivered to you. Once they have been delivered to you they are to be held at your own risk and we will not be liable for their loss or destruction. 

 

6.4 When we have agreed a delivery date with you and our carrier and you are not present to receive the delivery, we reserve the right to recover the cost of the failed delivery.

7 Faulty or Damaged Goods

7.1 Goods damaged in transit must be noted at the time of delivery, documented on the delivery note and the delivery refused. It is your responsibility to check the goods for damage with the delivery driver and to notify us within a reasonable period. We will not accept claims for goods damaged in transit that were signed for as being in good condition, unchecked or wording to that effect.

7.2 If the goods we deliver are incorrect to your order or are defective in any way we shall only have liability to you if the problem is reported in writing within 7 working days of delivery of the goods in question.

7.3 Any defective goods returned to us will be inspected and you will be entitled to a full replacement, re-delivered at our expense or a full refund including any delivery charges paid.

8 Your Right to Cancel 

 

8.1 Distance selling regulations give you the right to cancel any order within seven days of the delivery of your purchase (this is referred to as your cooling off period) whether the goods you receive are defective or not and the right to receive a full refund of your purchase price. 9 Liability 

 

9.1 We will use all reasonable endeavours to provide accurate information via this website but in providing such information we offer no warranty regarding this content, or warranties regarding the availability of the website, that it will be error free, that defects will be corrected and that the server that makes the site available will be free from viruses. As a consequence we cannot be liable to you in any way for any loss of content, material upload or transmitted through the website and will not be responsible or liable to you for any loss or damage from action taken or taken in reliance on material or information contained on the site.

9.2 We will accept no liability in contract for any economic losses, loss of goodwill or reputation, special or indirect losses suffered or incurred by any party arising out of or in connection with the provisions of any matter under these terms and conditions. Notwithstanding the above, our liability shall not at any time exceed the sum equal to the amount paid by you for any of the products. This provision, however, does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

9.3 We accept no liability for the installation, application or subsequent use of any goods supplied if this use is not within accepted operating procedures.

10 Privacy Policy 

 

10.1 Any personal information you send to us shall not be passed on to any third party for any reason unless it is directly related to your purchase.
